Terms of Service

1. About us and these terms
These Terms of Service ("Terms") govern your use of Presencly ("we", "us", "our") and any digital marketing services you purchase from us. By placing an order, you agree to these Terms.
Presencly is a UK-based digital marketing agency working exclusively with renewable-energy installers (solar PV, heat pumps, battery storage, EV chargers, boiler upgrades). Contact: support@presencly.co.uk
2. Our services
Presencly provides ongoing local search marketing services, which may include:
- Google Business Profile (GBP) claim, optimisation, and weekly posting.
- On-page SEO: page titles, meta descriptions, schema, internal linking, content rewrites.
- Off-page SEO: local citation submission and cleanup, guest posts, review acquisition support.
- Content production: blog posts and locally-driven landing pages.
- Technical SEO: site audits, schema, sitemap, analytics, Core Web Vitals fixes.
- Small website changes (sticky nav, FAQ blocks, gallery, contact details) within tier limits.
- Monthly rank reports and a quarterly or bi-weekly strategy call, per tier.
Specific deliverables depend on the tier you select ("Get Found", "Get Calls", or "Dominate the Region"). The current scope of each tier is the version published at presencly.co.uk at the time you sign up.
3. The ordering process
- Free audit — you submit your website at presencly.co.uk/audit or reply to one of our emails. We send a 2-minute Loom audit within 24 hours. No cost, no obligation.
- Onboarding call — a 20-minute call to confirm scope, agree the primary keyword(s) and town(s) for the guarantee, and select a tier.
- Setup fee — a one-off £499 setup fee is paid via Stripe. This covers the technical audit, GBP claim and full optimisation, citation cleanup, schema/sitemap/analytics setup, and the on-page work in the first month.
- Monthly retainer begins — your first monthly retainer payment is taken on the day work begins (Day 1 of the setup month).
A contract is formed when the setup fee is received and the first retainer payment authorised. Each prospect’s quote is valid for 30 days from issue.
4. Pricing and payment
All prices are in British Pounds Sterling (GBP) and inclusive of VAT where applicable.
Setup fee
£499, one-off, paid before work begins. Non-refundable in all circumstances except where Presencly cancels the engagement (section 8).
Monthly retainer
£299 / £499 / £1,299 per month depending on tier. Charged via Stripe on a recurring monthly basis, in advance, on the same day each month. Late or failed payments may pause delivery until the account is current.
Minimum term
All retainer plans have an initial 6-month minimum term. SEO results compound and a shorter commitment doesn’t produce ranking results we can stand behind. After the initial term, the retainer continues on a rolling monthly basis with 30 days’ written notice on either side.
5. The 90-day first-page guarantee
On the Get Calls and Dominate the Region tiers we guarantee that, by Day 90 of the engagement, your website or Google Business Profile will appear on the first page of Google for the keyword(s) and town(s) agreed in writing at onboarding.
"First page" means either (a) a position in the top 10 organic results on a desktop search from a UK IP, signed out, in incognito mode; or (b) a position in the top 3 of the Google Local Pack for the keyword and town. The easier of the two qualifies.
If we miss the target by Day 90, all monthly retainer payments made between Day 1 of the setup month and Day 90 are refunded pro-rata. The £499 setup fee is non-refundable because the work it pays for (GBP claim, citation cleanup, technical setup, schema) remains in your name and benefits you whether you stay with Presencly or not.
The guarantee applies provided you give us reasonable access to your Google Business Profile, hosting/CMS (or a developer contact), and respond to feedback requests within 5 working days. Periods of silence pause the 90-day clock by the corresponding number of days. Cancelling the engagement before Day 90 voids the guarantee.

6. Region exclusivity
On the Get Calls and Dominate the Region tiers, Presencly will not take on another renewable-energy installer client targeting the same town(s) named in your engagement, for the duration of your retainer up to a maximum of 12 months from the engagement start date.
After 12 months, exclusivity converts to first-refusal: if a competitor in one of your named towns approaches us, we will offer you the option to retain exclusivity by either extending your minimum term or increasing your retainer to a defensible level. If declined, we may take the new client.
"Named towns" are the specific towns recorded in your written onboarding email. A new prospect in a town you have not named is fair game and not a breach of exclusivity.
7. Your responsibilities
To allow us to deliver results inside the agreed timeframe, you agree to:
- Provide access to your Google Business Profile as a manager.
- Provide login access to your website CMS, or a direct line to your developer.
- Respond to feedback requests (small site changes, content sign-off, review templates) within 5 working days.
- Supply accurate, up-to-date business information, install photos, and customer review references on request.
- Hold and provide on request the rights to any content (images, logos, testimonials) we publish for you.
Delay or failure to provide the above may pause delivery and pause the 90-day guarantee clock by the corresponding number of days.
8. Cancellation
Setup fee
The £499 setup fee is non-refundable. By paying it, you authorise Presencly to commence work immediately and waive any statutory cooling-off rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Inside the 6-month minimum
If you cancel during the initial 6-month minimum term, the remaining retainer payments for that term become immediately due in full. This is to compensate for the long lead-time of SEO work (content, citations, and backlinks that have been initiated on your behalf).
The 90-day guarantee (section 5) is the only path to a partial refund during the minimum term.
After the 6-month minimum
The retainer continues month-to-month. Either party may cancel with 30 days’ written notice by email to support@presencly.co.uk. The notice period is billed normally. No refund will be issued for the current month or unused days.
If Presencly cancels
In the unlikely event Presencly cancels the engagement, we will refund any retainer payment for work not yet performed in the current month and waive any remaining minimum-term liability.
9. What you keep on cancellation
The following remain yours and in your name, with no portability fees, after cancellation:
- Your Google Business Profile and all reviews, photos, posts, and settings on it.
- All citation listings created or cleaned up during the engagement.
- All blog posts and landing pages published on your website.
- Any technical SEO work applied to your website (titles, descriptions, schema, sitemap, analytics).
- Guest posts and backlinks pointing at your domain.
We do not withhold any of the above as leverage. Presencly retains no access to your GBP or website once cancellation takes effect.
10. Intellectual property
Your content: You retain ownership of all photos, branding, and source materials you provide. You grant Presencly a non-exclusive licence to use them for the duration of the engagement.
Content we produce: Blog posts, landing pages, and GBP posts produced for you become yours on publication.
Portfolio use:Unless you instruct us otherwise in writing, Presencly may anonymously reference ranking results from your engagement in case studies and marketing materials (e.g. "a Cornwall solar installer"). Named references are only used with your written permission.
11. No guarantee of business outcomes
Except for the specific ranking guarantee in section 5, Presencly does not guarantee any particular business outcome — number of enquiries, calls, jobs won, revenue, or profit. SEO and local marketing improve visibility; conversion of that visibility into business depends on factors outside our control (your pricing, your salesmanship, your installation capacity, market conditions).
12. Limitation of liability
To the maximum extent permitted by law, Presencly’s total liability to you for any claim arising from these Terms or our services shall not exceed the total amount paid by you to Presencly in the 12 months preceding the claim.
We are not liable for any indirect or consequential loss, including loss of revenue, profits, business, or reputation, even if we have been advised of the possibility of such loss.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
13. Governing law
These Terms are governed by the laws of England and Wales. Disputes arising from these Terms or our services are subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to these terms
We may update these Terms from time to time. Changes are posted on this page with an updated "Last updated" date. Material changes affecting an existing engagement will be notified in writing to your registered email at least 30 days before they take effect.
